Protecting Proprietary Cosmetic Formulas During EU and UK Safety Assessment

How brands, manufacturers and safety assessors can exchange sensitive quantitative formulations without unnecessary disclosure.

VARANOS GLOBAL EDITORIAL   ·   PUBLISHED 25 OCTOBER 2026   ·   3 MIN READ

This guide summarises EU or GB requirements as understood in October 2026. For product-specific decisions, the appointed Responsible Person and qualified specialists must review the actual dossier.

Why formula confidentiality can block an otherwise straightforward launch

Factories producing private-label or contract-manufactured cosmetics may be unwilling to share exact percentage-by-weight compositions with brand customers. In many arrangements those concentrations are core commercial intellectual property. Yet the scientific safety assessment needs adequate quantitative formulation information. The solution is not to guess the formula or ask the brand to reverse-engineer it; it is to agree an authorised confidential information route.

Separate commercial visibility from regulatory access

A sensible workflow distinguishes public INCI labelling, product identity and project progress from restricted formula percentages and manufacturer-specific technical documents. The brand can see that a formula was submitted and whether the safety assessor has accepted the evidence without necessarily seeing the precise recipe. The assessor, RP and relevant competent authorities must still have the information their roles require. The precise legal and contractual arrangement must be established before collection.

What the manufacturer needs to know in its own language

Provide a concise written explanation identifying who receives sensitive files, who may access them, the purpose of collection, how the information is stored, how long it is retained and what happens if the parties change. For manufacturers in China, a professionally translated Chinese-language information sheet can remove ambiguity. It should not make impossible promises that 'only one person can ever see the formula' if the applicable regulatory regime requires broader authorised access.

The role of a secure portal

A factory upload link can reduce repetitive emails and keep documents tied to the correct version of a product. But security is not just a padlock icon: server-side role checks, access logs, encryption, sensible retention, invitation controls and meaningful incident procedures matter. A portal must never allow the brand to gain restricted data by changing a web page parameter, swapping an account role or opening a predictable file URL.

A trust advantage worth testing

A reliable confidentiality model may improve response rates from contract manufacturers who otherwise avoid sharing complete dossiers. That is a valuable hypothesis for Varanos to test with real factory partners. We would measure the proportion of requested documents supplied, delays avoided and any reduction in assessor back-and-forth — not merely assume the presence of a portal creates trust.
